EPA conducted an partial compliance evaluation of the facility on site on October 12-13, 2022, to determine compliance with the Clean Air Act Section 112r and 40 CFR Part 68. On February 17, 2023, EPA sent a Notice of Potential Violation and Opportunity to Confer letter to the facility. Based on the available information, EPA determined that the facility violated 68.150(a) for failure to submit an RMP registration, and the General Duty Clause Section 112(r)(1), for failing to design and maintain a safe facility by not taking the necessary steps to detect and prevent/mitigate butane releases.
