The products in the shipment described above were in violation of 40 C.F.R. ? 156.10 (a)(1)(ii) and 40 C.F.R. ? 156.10 (a)(1)(v) because the label for the product did not have the correct EPA establishment number. Therefore, the pesticide was misbranded pursuant to Section 2(q)(1)(D) of FIFRA, 7 U.S.C. ? 136(q)(1)(D).
