EPA filed with the Regional Hearing Clerk a Consent Agreement and Final Order memorializing a settlement for alleged violations of CAA 112(r)(7), Chemical Accident Prevention. The Aurora Cooperative Company, Inc. facility located in Harvard, NE is a retailer of anhydrous ammonia. An inspection of the facility by EPA on January 31, 2023, revealed alleged violations of the CAA 112(r)(7) and 40 CFR Part 68, Chemical Accident Prevention Provisions. These rules were promulgated by EPA to protect communities and the environment from releases of toxic and flammable hazardous substances, such as anhydrous ammonia, whenever companies, like Aurora Cooperative Company, Inc., manufacture, process, use, or store regulated substances at their facilities.
