Summary

On February 2, 2024, EPA Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Ryan Smith and Noah Smith located in Central, Alaska. Respondents discharged dredged and fill material into waters of the United States without a Clean Water Act Section 404 permit or authorization from the U.S. Army Corps of Engineers. The unauthorized discharges occurred in adjacent wetlands with continuous surface connection to Crooked Creek. The unauthorized work included the use of heavy equipment to mechanically clear the wetlands resulting in discharges of pollutants, including overburden soils, gravel, sediments, and woody debris.
