Summary

On December 6, 2023 the EPA entered into an Administrative Order on Consent (AOC) with Jabil, Inc. of Monument, Colorado to resolve the facility?s violations of the pretreatment regulations. On 9/01/23, NPDES Enforcement sent a Notice of Violation and Opportunity to Confer (NOVOC) to Jabil outlining the facility?s violations. Violations cited in the AOC and outlined in the NOVOC were identified during prior quarterly submittals of the facility?s Discharge Monitoring Reports (DMRs) and included the following: Exceedances of the facility?s zinc daily average limit; Exceedances of the facility?s zinc monthly average limit; Exceedances of the facility?s nickel monthly average limit; Failure to notification requirement; Failure to sample during monitoring period. Jabil is a manufacturer of titanium and stainless-steel screws, screw blanks, and nails used in orthopedic devices. Wastewater discharges from Jabil to the Monument Sanitation District and Tri-Lakes publicly owned treatment works are subject to Categorical Pretreatment Standards in the Metal Finishing Point Source Category 40 C.F.R. ? 433. EPA directly implements the pretreatment regulations in Colorado and serves as the control authority for Jabil because Monument does not have an approved pretreatment program. The AOC requires Jabil to conduct and submit monthly effluent sampling for the duration of the order; notify EPA within 24 hours of becoming aware of any effluent violation, and to submit analytical results
