On January 10, 2024, Region 3 entered a Consent Agreement and Final Order with The Bullen Companies for EPCRA recordkeeping violations at its specialty cleaning products manufacturing facility in Folcroft, PA. The violations involved a failure to retain and present records required to assess compliance with Toxics Release Inventory reporting requirements. Such violations frustrate compliance assessment, the ability of the public to be fully informed about releases of toxic chemicals and other goals of EPCRA. PADEP was provided notice of the planned enforcement action and had no objections. The settlement required the respondent to certify compliance with applicable EPCRA requirements and to pay a $11,949 penalty. The facility is in an area of potential EJ concern.
