The Regional Judicial Officer issued a Final Order on January 16, 2024, ratifying the Consent Agreement to commence and settle a penalty action to resolve violations of EPCRA Section 312 against LeachGarner, Inc. d/b/a John C. Nordt Company. On September 24, 2021, EPA conducted an inspection of the John C. Nordt manufacturing facility (Facility) in Roanoke, VA following a release of anhydrous ammonia, which occurred on April 5, 2021. The Consent Agreement alleges failure to submit to the SERC, LEPC, and local fire department by March 1, 2021, a chemical inventory form and failure to submit chemical inventory report forms for calendar years 2019, and 2018 as required by EPCRA Section 312. The settlement provides that LeachGarner, Inc. will pay a penalty of $25,612. According to EJ Screen, the Facility is not located in a potential area of EJ concern. EPA directly implements enforcement of EPCRA; Virginia DQE was informed of this action.
