Summary

On December 20, 2023, the Director of the Office of Civil Enforcement, on behalf of Regions 3 and 5, entered into a RCRA 3013 Administrative Order on Consent (Agreement) with Chemours Company FC, LLC (Chemours) whereby Chemours has agreed to conduct per- and polyfluoroalkyl substances, or PFAS, sampling surrounding its Washington Works facility (Facility) in Washington, West Virginia. Under the Agreement, Chemours will take samples and analyze soil, surface water, sediment, groundwater, and certain waste streams generated by the facility to collect information on known and potential PFAS contamination. The Agreement will provide additional data for EPA to better understand the extent of PFAS contamination and how transferring PFAS-containing waste streams to other disposal sites may impact other communities. The Agreement is part of EPA?s FY2024-2027 National Enforcement Compliance Initiative on Addressing Exposure to PFAS. The Facility is located on the Ohio River bordering Ohio. Regions 3 and 5 will work together to oversee the Respondent?s work in its respective regions. The Facility is not located in an EJ area of concern.
