EPA has claims against the Defendant for past and potential future response costs under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended (CERCLA), 42 U.S.C. 9601-9675, with respect to the Newtown Creek Superfund Site located in Queens and Kings Counties, New York. EPA has incurred response costs in conducting response activities at the Site.
