On January 22, 2024, Region 3 issued a Unilateral Administrative Order ( UAO or Order ) to Howard Holzmacher Sr., Howard Holzmacher, Jr., and North Landing Firewood and Hauling, inc. ( Respondents ) for activities located at 3829 North Landing Road, Virginia Beach, Virginia, 23456 ( Site ) in violation of Section 404 of the CWA. Based on evidence gathered during a July 26, 2022, EPA inspection, the UAO alleges the Respondents discharged dredged and/or fill material into waters of the United States without authorization from the United States Army Corps of Engineers. The Order requires the Respondents to cease and desist all unpermitted discharges at the Site and provide a restoration and mitigation plan. The Virginia Department of Environmental Quality was informed. EPA does not consider the area in the near vicinity of the Site to be an EJ area of concern.
