Summary

On January 31, 2024, the Division Director of ECAD, EPA R3 issued an Administrative Order for Compliance on Consent ( Order ) under Section 309(a) of the Clean Water Act ( CWA or Act ), 33 U.S.C. 1319(a) to the Lawrenceville Borough for alleged violations at Lawrenceville's wastewater treatment plant facility located at Cherry Street, Lawrenceville, Pennsylvania. Violations include 93 effluent limit exceedances from Outfall 001 between June 30, 2017, and October 31, 2022 with the highest percentage of exceedances occurring for carbonaceous biochemical oxygen demand (CBOD5), followed by fecal coliform and total suspended solids. In addition, Respondent has not properly operated and maintained the Facility by failing to properly control the volume and composition of indirect discharges to the Facility, and failing to keep accurate records for the WWTP since June 2017. The AOC requires Lawrenceville to submit certain documents to EPA and implement certain activities in order to meet the requirements of the NPDES General Permit for Discharges of wastewater Associated with its Permit PA0111929 ( WWTP Permit ), issued by Pennsylvania Department of Environmental protection (PADEP), which became effective on January 1, 2020, with an expiration date of December 31, 2024. Within sixty (60) days of the Effective Date of the AOC, the Respondent shall provide to EPA for review a Corrective Action Plan ( CAP ), which meets the requirements set forth in this AOC.
