On February 16, 2024, Region 3 issued a consent agreement and final order that resolves a Clean Water Act case against JO Associates LLC, a residential home construction company for construction stormwater violations at the Townhomes at Michigan Park construction site, located at 4451 Joseph Pl., NE, Washington, D.C. EPA cited the following violations: failure to obtain NPDES permit coverage prior to the start of construction activities and discharge of stormwater without an NPDES permit in violation of CWA Section 301. The consent agreement and final order requires JO Associates, LLC to pay a $40,500 civil penalty to settle the matter. The facility is not located in a potential EJ area of concern. This action helps protect local waterways, including the Chesapeake Bay. EPA has consulted with DOEE during the development of this action.
