On July 25, 2024, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Venoil, LLC (Respondent) at its used oil bulk storage and processing facility in Anacortes, Washington. Respondent failed to adequately implement Clean Water Act Section 311 spill prevention, control and countermeasure (SPCC) requirements which resulted in numerous SPCC 40 C.F.R. Part 112 violations including the failure to implement formal oil storage tank integrity testing and inspections and to properly conduct a failure analysis of equipment and processes necessary to prevent and respond to oil spills. This action ensures the Respondent will take necessary SPCC implementation measures, including certified inspector-conducted integrity tank testing as means to protect regional surface waters like Padilla Bay from oil spills. The Respondent has agreed to pay a penalty of $57,800 and has initiated implementation of an updated, revised SPCC Plan designed to promote compliance at its Anacortes location.
