## Summary

On January 29, 2020, EPA performed an inspection of Hatcher Mobile Services, LLC. EPA observed disabled exhaust aftertreatment systems and several suspected defeat devices in Respondent?s parts warehouse and storeroom. EPA issued an Information Request on August 27, 2020. Based on Hatcher?s responses to EPA?s Information Request, which included invoices, receipts, and other records, EPA issued a Finding of Violation (FOV) to Hatcher alleging violations of Section 203(a)(3)(A) and (B) of the CAA, 42 U.S.C. ? 7522(a)(3)(A) and (B) on November 18, 2022. The FOV alleges Hatcher had in at least 109 instances knowingly removed or rendered inoperative devices or elements of design installed in CAA-compliant motor vehicles or engines, in violation of Section 203(a)(3)(A) of the CAA, 42 U.S.C. ? 7522(a)(3)(A); and in at least 273 instances sold, or offered to sell, and/or installed parts or components that it knew or should have known were being offered for sale or installed to bypass, defeat, or render inoperative devices or elements of design installed in CAA-compliant motor vehicles or engines (?defeat devices?), in violation of Section 203(a)(3)(B) of the CAA, 42 U.S.C. ? 7522(a)(3)(B).
