## Summary

On March 25, 2024, EPA filed a Consent Agreement and Final Order in which Everett's Auto Parts, Inc. (Everett's Auto) will pay a penalty of $74,551 for alleged violations of the federal Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP) and the Oil Pollution Prevention regulations.  EPA inspections of Everett's Auto's used auto parts and scrap metal recycling facility in Brockton, Massachusetts (Facility) revealed that Everett's Auto had failed to identify scrap metal recycling as a co-located industrial activity and had not been sampling all necessary parameters, failed to properly identify all outfalls, and had greater than 1,320 gallons of above-ground oil storage capacity without adequate secondary containment or a fully prepared and implemented Spill Prevention, Control, and Countermeasure plan.  After EPA's inspections, Everett's Auto Parts submitted a change to its Notice of Intent to include scrap metal recycling and identify additional outfalls.  The Facility also constructed secondary containment around above-ground storage tanks.  The Facility is located in an area where residents are impacted by environmental justice issues. EPA coordinated with the Massachusetts Department of Environmental Protection in this matter.
