Summary

On March 28, 2024 after a thirty day comment period, EPA sent out a letter putting into effect a settlement agreement previously negotiated with St. Croix Petrochemical Corporation (SCPC) related to the former SCPC manufacturing facility that operated in the past on a portion of the former HOVENSA refinery in St. Croix, U.S. Virgin Islands. The agreement provides for the transfer by SCPC of its remaining assets of approximately $1.7 million to the Hovensa ERT to help fund remediation of contamination caused by SCPC in the past at the former HOVENSA facility. The ERT was established during the HOVENSA, LLC bankruptcy proceedings, to, among other things, implement RCRA corrective action cleanup measures at the former HOVENSA facility. The United States is a beneficiary of the ERT. As part of the agreement, EPA provided the company with covenants not to sue under CERCLA Sections 106 and 107(a) and RCRA Sections 3013 and 7003.
