On March 19, 2024, EPA and Navisun LLC (Navisun) settled an administrative penalty case addressing alleged violations of the General Permit for Discharges from Construction Activities (CGP) at the company's solar farm development site in Acushnet, Massachusetts. EPA alleged two CGP violations against Navisun for uncontrolled stormwater discharges from Navisun's construction site in December 2022 and for failure to stabilize large areas of the site in Spring 2023. Navisun has corrected the violations by improving its site controls and ground stabilization measures. EPA and Navisun settled the case with a Consent Agreement and Final Order that both initiated and concluded the action with Navisun agreeing to pay a settlement penalty of $25,000. EPA implements the National Pollutant Discharge Elimination System program in Massachusetts and consulted with the Massachusetts Department of Environmental Protection on this matter.
