## Summary

Region 5 filed a Consent Agreement and Final Order (CAFO) to commence and conclude an administrative penalty action against Southern Indiana Gas and Electric Company (SIGECO). SIGECO owns and operates two coal-fired electric utility steam generating unit sources (Unit 2 and Unit 3) at the F.B. Culley Generating Station located in Newburgh, Indiana. 

In reports submitted pursuant to the NESHAP for Coal- and Oil-Fired Electric Utility Steam Generating Units (Subpart UUUUU), SIGECO identified mercury emission limit deviations that began when Unit 3 experienced a catastrophic boiler feed pump turbine failure in June 2022 and remained out of service through mid-March 2023. EPA has alleged that SIGECO exceeded its 30-boiler-operating-day rolling average emission limit for mercury at Unit 2 on certain boiler operating days between September 12, 2022 and March 13, 2023, in violation of 40 C.F.R. ? 63.9991(a)(1) of NESHAP UUUUU, and of the corresponding provision in the facility?s Part 70 Operating Permit.

The SIGECO facility is not located in an EJ area of concern. The Indiana Department of Environmental Management was notified of this action.

Under the CAFO, SIGECO will pay a $81,500 civil penalty for the alleged violations. SIGECO has certified that it is complying with Subpart UUUUU and the corresponding provision of the facility?s Part 70 Operating Permit.
