Summary

On April 12, 2024, EPA Region 6, sent a Proposed Administrative Order under its authority pursuant to Section 1421 of the Safe Drinking Water Act to Smith Petroleum, LLC Barnsdall, Oklahoma, Texas. The Proposed AOC was issued because Respondent failed to successfully demonstrate mechanical integrity and (40 C.F.R. ?? 147.2903(b), 147.2905, and 147.2909) maintained injection wells in a manner that could allow fluid movement into a USDW. During the week of June 25, 2024, a Final Administrative Compliance Order (Final AO) will be issued to Smith Petroleum, LLC (Respondent). The Final AO alleges Respondent violated regulations set forth at 40 C.F.R. ?? 147.2903(b), 147.2909, 147.2912(a) by failing to successfully demonstrate mechanical integrity of an injection well located in Osage County, Oklahoma. The Final AO requires the Respondent to successfully demonstrate mechanical integrity of the injection well, plug the injection well or convert it to production use.
