FIFRA Notice of Warning:
HD Hyundai Robotics USA Inc.
The U.S. Environmental Protection Agency (EPA) has obtained evidence indicating that HD Hyundai Robotics USA Inc. (HD Hyundai) appears to be, or has been, in violation of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA).
Pursuant to Section 12(a)(1)(F) of FIFRA, 7 U.S.C. ? 136j(a)(1)(F), it is unlawful for any person to distribute or sell to any person any pesticide device that is misbranded. The EPA alleges that HD Hyundai sold or distributed a pesticide device that is misbranded in that the label did not bear the registration number assigned under section 7. Additionally, the D1 device is misbranded in that the label included unqualified claims (sterilization, disinfection, etc.) concerning the effectiveness of the product.
Pursuant to FIFRA Section 12(a)(2)(N) of FIFRA, 7 U.S.C. ? 136j(a)(2)(N) it is unlawful for any person to fail to file reports required by the Act. For the shipments described above, the importer or the importer's agent did not file or did not complete: a NOA prior to the arrival of the shipment in the U.S. or; an electronic alternative to the NOA filed with the entry documentation via any CBP authorized electronic data interchange system.
