On April 17, 2024, the EPA Region III entered into a Consent Agreement and Final Order ( CAFO ) with Erie Hard Chrome, Inc. ( Respondent ) alleging violations of EPCRA and implementing regulations in connection with the failure to submit toxic chemical inventory forms for lead in calendar years 2019, 2020, and 2021 by July 1 of 2020, 2021, and 2022, respectively. This enforcement action furthers EPCRA's purpose of helping increase the public's knowledge and access to information on chemicals at individual facilities, their uses, and releases into the environment. The CAFO resolves allegations that Respondent failed to report lead at its Erie, PA facility in reportable quantities in violation of Section 313 of EPCRA, 42 U.S.C.11023. In the CAFO, Respondent attests to its compliance with Section 313 of EPCRA, and it will pay a penalty of $31,653 for the alleged violations of Section 313. The facility is located in an area of EJ Concern. Five National EJ Indexes were at or above the 90th percentile, including Air Toxics Cancer Risk, Toxic Releases to Air, Lead Paint, and RMP Proximity. The EPA notified the Pennsylvania Department of Labor and Industry.
