On 2/1/24, EPA Region 6 issued a Formal Notice of Warning to Energy Solutions (US) LLC, of Princeton, NJ, for alleged violations of Section 12(a)(2)(L) of FIFRA, 7 U.S.C. Section 136j(a)(2)(L). The EPA alleges that Energy Solutions (US) failed to timely file pesticide production reports (EPA Form 3540-16) for its EPA-registered establishments 102007-TX-1 (reporting year 2022), 102007-TX-2 (reporting year 2022), 102007-TX-3 (reporting year 2022), and 102007-TX-4 (reporting years 2019, 2020, 2021, & 2022), as required by Section 7(c) of FIFRA, 7 U.S.C. Section 136e(c).
