Pursuant to FIFRA ? 2(q)(1) a pesticide or a device declared subject to the Act pursuant to ? 152.500, is misbranded if its labeling is false or misleading in any particular, including both pesticidal and non-pesticidal claims. The Philips NaturalTrust UV-C LED Module appears to make claims which are false or misleading concerning the effectiveness of the device. Claims such as ?disinfection? shall be numerical and qualified as to the specific microorganisms which a device is tested against. Unqualified claims are considered false or misleading pursuant to 40 C.F.R. 156.10(a)(5)(ii) and/or (vii).
