On May 5, 2024, EPA, Region 3 issued a CAFO that commenced and concluded a Clean Water Act enforcement case involving The Parks at Walter Reed, a multi-use development consisting of multifamily buildings and townhomes, office buildings, new roads, a parking garage, and a plaza area, located at 6900 Georgia Avenue NW, Washington, D.C. 20012 (Facility). In the Consent Agreement, EPA alleged that Respondents TPWR Developer, LLC (TPWR), CBG Building Company LLC (CBG), and Bowman Consulting DC (Bowman) violated Section 301 of the CWA, by engaging in construction activity and discharging stormwater without permit coverage under the National Pollutant Discharge Elimination System (NPDES) Construction General Permit (CGP). To correct these violations, Respondents submitted Notices of Intent (NOIs) for coverage under the Construction General Permit and these NOIs were approved by EPA. In the Consent Agreement, the Respondents agreed to pay a civil penalty of $27,000, and complete a Supplemental Environmental Project (SEP) involving restoration of trails and plantings in Rock Creek Park designed to preserve the Hays Spring Amphipod, Washington DC's only endangered species. This is Region 3's first SEP since DOJ restored EPA's ability to include SEPs in settlements. The Facility is in an area of EJ concern. EPA consulted with DOEE, the Department of the Interior and the National Parks Service during the development of this action.
