Summary

On June 7, 2024, EPA Region 10 filed a Consent Agreement and Final Order resolving violations of the Emergency Planning and Community Right-to-Know Act (EPCRA) and Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) by Clearwater Paper Corporation located in Lewiston, Idaho. Clearwater Paper Corporation owns and operates a facility which failed to timely report releases of chlorine to the National Response Center as required under CERCLA Section 103, and release of chlorine to the State Emergency Response Commission and the Local Emergency Planning Commission as required und EPCRA 304. CERCLA 103 and EPCRA 304 emergency chemical release reporting supports emergency first responders ability to times respond to chemical releases and provides the public and local governments with information to protect themselves from the releases. The facility is located in an area of significant EJ concerns. Clearwater Paper Corporation agreed to pay a penalty of $ 322,088. $84,769 of the Assessed Penalty reflects violations of CERCLA, and $237,319 of the penalty reflects violations of EPCRA.
