Five Star Cooperative is a company supplying anhydrous ammonia as a retailer to use for fertilizer. The company is subject to the Program 2 requirements of 40 CFR Part 68, also known as the Risk Management Program rule. As a result of an inspection, two violations of 40 CFR Part 68 were identified. EPA Expedited Settlement Agreements are utilized to assess penalties in cases where the violations are minor, easily correctable and when the violations pose no imminent and substantial endangerment to human health and/or to the environment.
