EPA alleged Chromium Inc violated 40 C.F.R. Part 63, Subpart N at (1) 40 C.F.R. � 63.342(f)(1)(i) and (ii) for failing to operate the electroplating tanks with good air pollution control practices by allowing the scrubber pressure gauges to continuously fog, (2) 40 C.F.R. � 63.342(f)(3)(i) by failing to create and follow an operation and maintenance plan for the electroplating tanks and control devices, and (3) 40 C.F.R. � 63.342(b) for failing to maintain records of maintenance and malfunctions.
This ACO requires Chromium Incorporated to use an independent third party to complete a one-time service and inspection of the scrubber. The results of this inspection must be submitted to the EPA and Chromium Incorporated must implement all corrective actions necessary. Chromium Incorporated must also create and submit to EPA an operations and maintenance plan for approval, and must submit to EPA all records generated per 40 C.F.R. � 63.346(b) in the four 90-day quarters after the effective date of the order.
