On July 8, 2024, Region 10 filed an expedited settlement agreement which both initiated and concluded an administrative action against Dickinson Frozen Foods dba IdaCold LLC for violations of CAA ? 112(r) Risk Management Program requirements.  Respondent failed to comply with several risk management program requirements that apply to its use of anhydrous ammonia.  Dickinson Frozen Foods dba IdaCold LLC was late in conducting the facilities Process Hazard Evaluation within the required 5-year timeline. Secondly, Dickinson Frozen Foods dba IdaCold LLC did not update emergency contact information within 30 days of change, as required. Thirdly, Dickinson Frozen Foods dba IdaCold LLC failed to properly document training of their operators in safely operating the refrigeration equipment in preventing an ammonia release that could impact the community surrounding its facility.  A plan provides important information to emergency responders and planners that include accurate chemical quantities, emergency contacts and demonstrate operation and maintenance of the ammonia refrigeration process at its facility.  Lastly, Dickinson Frozen Foods dba IdaCold LLC failed to replace faulty equipment (safety release valves) within an appropriate timeline as described by the equipment manufacturer. According to EJScreen, this facility is not in an area of potential EJ concerns.  The company agreed to pay a penalty of $2,600.
