On May 24, 2024, Region 3 issued a CAFO that commenced and concluded a matter against Felman Production LLC, a ferroalloy manufacturing facility, to address industrial wastewater and stormwater NPDES permit violations at its facility located at 4442 Graham Station Road, Letart, West Virginia 25253 (the Facility ). The cited violation is for 72 effluent exceedances. The CAFO settles the violations with a civil penalty of $290,773. The CAFO is subject to public comment. The Facility is not in an area of EJ concern. None of the supplemental EJ Indexes are at-or-above the 90th percentile in the nation or in the state for the area. EPA has consulted with West Virginia Department of Environmental Protection during the development of this action.
