On July 16, 2024, Region 10 filed an expedited settlement agreement resolving violations of CAA 112r related to operation of anhydrous ammonia refrigeration system in Prosser, Washington. Zirkle Fruit Company failed to install safety equipment in their engine room to meet current industry codes and standards such as International Institutes of Ammonia Refrigeration (IIAR), retain their process hazard analysis for the life of the process, certify their compliance audits every three years, conduct a hazard assessment every five years, correct equipment deficiencies such replace pressure relief valves, and conduct a pre-start up safety review for new installed equipment such as their inorganics hydrocooler. The facility is in an EJ area with a supplemental indices national percentile of 92. Under the terms of the agreement, the facility paid a penalty of $9,100.
