June 21, 2024, Region 3 issued a Consent Agreement and Final Order (CAFO) to Saarim, Inc. (Respondent) the operator of a facility with underground storage tanks at 1923 Pulaski Highway, Bear, Delaware, 19701 (Site) in violation of Section 9006 of the RCRA. Based on evidence gathered during a January 31, 2022, EPA inspection, the EPA alleges failure to test line leak detectors annually and failure to provide release detection monitoring. The CAFO requires the Respondent to pay a penalty of $8,942.00. The Delaware Natural Resources and Environmental Control was informed. The EPA does consider the area in the near vicinity of the Site to be a potential EJ area of concern.
