On July 9, 2024 EPA Region 3 issued a Consent Agreement and Final Order entered into with Aalberts Surface Treatment Corp. This Agreement initiated the action and settled alleged violations of RCRA Subtitle C. The company's facility in Baltimore, MD is a job-shop metal coater. EPA determined that the facility violated the hazardous waste regulations by storing hazardous waste beyond the allowed time limits, outside of containers, and in containers which were not properly labeled, dated or closed. In addition, the facility failed to: minimize the possibility of a release of hazardous waste, conduct and document weekly inspections, conduct hazardous waste training and maintain related documents, maintain an adequate contingency plan, conduct adequate waste determinations, and maintain adequate land disposal restriction forms. Region 3 notified Maryland, which had no objections to this action. Per the terms of the Consent Agreement, Aalberts Surface Treatment Corp. will pay a civil penalty of $260,000. The Facility is in an area of EJ concern.
