On June 18, 2024, EPA filed a Consent Agreement and Final Order (CAFO) resolving an action against Elite Construction and Remodeling, LLC (Respondent) for alleged violations of TSCA and the Renovation, Repair and Painting Rule (RRP Rule). Following an anonymous complaint, EPA conducted an inspection of Respondent's worksite in Mystic, Connecticut and identified multiple RRP Rule violations. The Respondents failed to obtain initial certification from EPA prior to performing renovation work on a pre-1978 residential property, assign a certified renovator to the renovation project, properly contain exterior work area by covering the ground with plastic to collect falling paint debris, and retain all records necessary to demonstrate compliance for at least three years. While the renovation project was not located in an environmental justice area of concern, a child under the age of 6 was residing at the property where the alleged violations occurred. Under the CAFO, which initiated and concluded EPA's enforcement action simultaneously, the Respondents will pay a penalty of $39,368. The Respondents have also corrected the alleged RRP Rule violations. The RRP Rule is not delegated to the State, but the Connecticut Department of Public Health has been made aware of this case.
