On September 4, 2024, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Darigold, Inc. for its Washington Department of Ecology National Pollutant Discharge Elimination System (NPDES) Industrial Stormwater General Permit (ISGP) Facility in Spokane, Washington. Darigold, Inc. violated the ISGP due to failure to submit a complete notice of intent, failure to meet sampling requirements, inadequate best management practices, inadequate Stormwater Pollution Prevention Plan (SWPPP) and inadequate inspection documents. The Respondent has agreed to pay a penalty of $146,925 and are under a separate administrative order to return to compliance. The facility impacts an area with environmental justice concerns.
