On September 4, 2024, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Darigold, Inc. for its Washington Department of Ecology National Pollutant Discharge Elimination System (NPDES) Industrial Stormwater General Permit (ISGP) Facility in Lynden, Washington. Darigold, Inc. violated the ISGP due to prohibited discharges, inadequate sampling procedures, inadequate Best Management Practices (BMPS), inadequate Stormwater Pollution Prevention Plan (SWPPP) and unauthorized bypasses. The Respondent has agreed to pay a penalty of $198,000 and are under a separate administrative order to return to compliance.
