On September 4, 2024, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Darigold, Inc. for its Washington Department of Ecology National Pollutant Discharge Elimination System (NPDES) Industrial Stormwater General Permit (ISGP) Facility in Chehalis, Washington. Darigold, Inc. violated the ISGP due to prohibited discharges, sampling using alternative lab methods without documentation, inadequate sampling documentation, inadequate Stormwater Pollution Prevention Plan (SWPPP), inadequate best management practices and inadequate site inspection documents. The Respondent has agreed to pay a penalty of $192,500 and are under a separate administrative order to return to compliance. The facility impacts an area with environmental justice concerns.
