On September 4, 2024, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Darigold, Inc. for its Individual National Pollutant Discharge Elimination (NPDES) and Multi-Sector General Permit (MSGP) Facility in Caldwell, Idaho. Darigold, Inc. failed to meet effluent limit violations and failed to have an adequate Quality Assurance Plan (QAP) under it?s individual NPDES Permit. In addition, Darigold, Inc. violated the MSGP due to unauthorized discharges, inadequate control measures, failure to conduct a routine inspection during a stormwater discharge, inadequate corrective actions, inadequate Stormwater Pollution Prevention Plan (SWPPP), failure to monitor all outfalls and failure to take representative samples. The Respondent has agreed to pay a penalty of $318,000 and are under a separate administrative order to return to compliance. The facility impacts an area with environmental justice concerns.
