Summary

On July 2, 2024, the EPA Region III entered into a Consent Agreement and Final Order ( CA/FO ) with Arconic US LLC ( Respondent ) alleging violations of EPCRA and implementing regulations in connection with the failure to complete and accurate toxic chemical inventory forms for Chromium, Ethylbenzene, Methyl Isobutyl Ketone, Toluene and Naphthalene in calendar years 2021 and 2022 by July 1 of 2022 and 2023, respectively. This enforcement action furthers EPCRA's purpose of helping increase the public's knowledge and access to information on chemicals at individual facilities, their uses, and releases into the environment. The CA/FO resolves the allegation that Respondent failed to accurately report its environmental releases/offsite transfers of Chromium, Ethylbenzene, Methyl Isobutyl Ketone, Toluene and Naphthalene at its Lancaster, PA facility. This constitutes violations of Section 313 of EPCRA, 42 U.S.C. 11023. In the CAFO, Respondent attests to its compliance with Section 313 of EPCRA, and it will pay a penalty of $110,000 for the alleged violations of Section 313. The facility is located in an area of EJ Concern.
