Summary

On March 21, 2024, EPA issued an Administrative Order on Consent pursuant to Section 7003 of the Resource Conservation and Recovery Act (RCRA) to Historic Cargill Falls Mill, LLC (Cargill Falls), the owner of an apartment complex located in Putnam, Connecticut, to address lead-based paint and/or lead dust hazards in 50 apartments. EPA determined that the deteriorated lead-based paint and lead dust at the complex, known as the Lofts at Cargill Falls Mill (Property), constitute solid wastes that pose an imminent and substantial endangerment to health or the environment. The Property was built in 1850 for use as a cotton mill and was converted into residential use. In 2022 and 2023, after lead-based paint and lead dust hazards were identified in units with children under six years old, the local health department issued abatement orders to Cargill Falls and the lead-based paint and lead dust hazards in units with young children were abated. EPA's order addresses all other units (a total of 50 units) at the Property where lead-based paint and lead dust hazards were identified. Some of the units house children older than six. Pursuant to the order, all occupied units will be abated by August 31, 2024 and the remainder will be abated by September 30, 2024. EPA will notify the State of our action.
