Summary

On July 30, 2024, Region 3 issued an Administrative Orders on Consent (AOC) to the United States Army, Aberdeen Proving Ground - Edgewood Area (Aberdeen) for failure to comply with the requirements of Section 1433 of the SDWA, as amended by the America's Water Infrastructure Act (AWIA) of 2018. Section 1433 required that PWSs serving over 3,300 people conduct a Risk and Resilience Assessment (RRA) of the PWS including risks of malevolent acts and natural hazards. No later than six months after completion of the RRA, the PWS had to prepare or revise an emergency response plan (ERP) to address the RRA findings. Covered PWSs had to certify to the EPA that they had conducted the RRA and revised the ERP by the deadlines specified by AWIA. The EPA issued the AOC to Aberdeen because it had not complied with the requirement to prepare or revise the ERP by the specified deadline. The EPA directly implements the Section 1433 requirements, but the EPA has notified Maryland of the action against the facility.
