On September 25, 2024, Region 10 filed an expedited settlement agreement resolving CWA violations of the state of Washington's Construction Stormwater General Permit by HD Fowler Corporation at its construction site in Port Orchard, Washington. Alleged violations included discharges not identified in the site's Stormwater Pollution and Prevention Plan (SWPPP), failure to install and maintain stormwater controls, missing sampling data in weekly site inspection reports, and failure to update and maintain the SWPPP according to the written standard. This enforcement action stands to reduce 39,747 pounds of stormwater sediment discharged into Gorst Creek. The Respondent agreed to pay a penalty of $2,220, and has returned to compliance.
