## Summary

On August 21, 2024, Region 3 entered a Consent Agreement and Final Order with 1000 Dual Highway, LLC ( the Respondent ), doing business as Hagerstown Gas & Go Inc ( the Facility ), for RCRA underground storage tank ( UST ) management violations.  The Respondent is a retailer of petroleum products in Hagerstown, Maryland.  The violations involved failure to provide adequate release detection, failure to report a suspected release to the Maryland Department of the Environment (MDE) within 2 hours, and failure to immediately investigate a suspected release.  Such violations can result in significant petroleum product leaks which can be harmful to both human health and the environment.  The settlement required the respondent to certify that it is now in compliance with applicable UST requirements, and to pay a $10,219 penalty.  MDE was notified of the enforcement action and did not express any concerns. The Facility is located in an area of potential EJ concern.
