On August 21, 2024, EPA entered into an expedited settlement agreement (Agreement) with Barkley Enterprises, LLC, addressing alleged violations of the General Permit for Discharges from Construction Activities (CGP) at the Murray Road Residential Development site (Site) in Ashburnham, Massachusetts. An EPA inspection at the Site revealed that Barkley Enterprises LLC had failed to fully implement stormwater controls as required by the CGP. Pursuant to the Agreement, the company will pay a $9,360 penalty. EPA implements the National Pollutant Discharge Elimination System program in Massachusetts. The case team consulted with the Massachusetts Department of Environmental Protection on this matter.
