On August 21, 2024, the EPA Region 3 entered into a Consent Agreement and Final Order with Renewal by Andersen, LLC resolving allegations that it had violated the Renovation, Repair and Painting Lead Based Paint rules (RRP) under 40 C.F.R. Part 745, Subpart E, in connection with the renovation of nine (9) residential properties located in Pennsylvania. A March 9, 2023 Records Inspection revealed that at the time renovation work was being performed, the subcontractors hired by Renewal by Andersen, LLC were not certified firms. Renewal by Andersen, LLC therefore, failed to ensure that all renovations performed by the firm are performed in accordance with the work practice standards in 40 C.F.R. 745.85, including that all firms conducting renovations be firm certified, in violation of 40 C.F.R. 745.89(d)(3). These TSCA requirements protect public health and the environment by protecting occupants of potential lead risks in residential properties. The properties at issue were not in Environmental Justice Communities of Concern. The Commonwealth of Pennsylvania was notified of this action. Under the consent agreement, Renewal by Andersen, LLC will pay a civil penalty in the amount of Thirteen Thousand Nine Hundred and Sixty-Eight Dollars ($13,968) to settle the alleged violations.
