This Consent Agreement and Final Order (CAFO) settled an enforcement action against The Respondent, which is the owner and operator of a coal-fired power generating facility located in Guayama, Puerto Rico. The CAFO resolves a civil administrative action against the Respondent for failure to comply with the Clean Air Act and various provisions of the applicable National Emission Standards for Hazardous Air Pollutants, 40 C.F.R. Part 63 Subpart UUUUU, for Coal- and Oil-Fired Electric Utility Steam Generating Units, (the Mercury and Air Toxics Standards, or MATS), codified at 40 C.F.R. ? 63.9980 et seq. Respondent failed to, among other things, comply with mercury emission limits, properly operate the sorbent trap monitoring system, conduct required testing, keep appropriate records, submit required reports, and certify equipment.
