Summary

On September 4, 2024, EPA filed a Consent Agreement and Final Order (CAFO) resolving violations of the Toxic Substances Control Act, the Residential Lead-Based Paint Hazard Reduction Act and the Lead-Based Paint Disclosure Rule (Disclosure Rule) alleged against Chinburg Management, LLC and Washington Street Mill, LLC. Washington Street Mill, LLC owns a residential property in Dover, New Hampshire and Chinburg Management, LLC oversees property management of the 88 residential units in the building. EPA commenced an investigation upon reports of potential lead-dust exposure and lead-paint based hazards that could lead to elevated blood lead levels in child residents of the building. Inspections revealed the presence of lead-based paint hazards in at least one residential unit of the building and that Respondents did not provide proper disclosure to tenants before they became obligated to lease units in the building. The CAFO requires Respondents to pay a penalty of $42,000 and to come into compliance with the Disclosure Rule. The property at issue is located in an area of environmental justice concern. In New Hampshire, the Disclosure Rule is enforced by EPA as the program has not been delegated to the State.
