EPA initiated this civil administrative penalty action against Respondent pursuant to section 14(a) of the Federal Insecticide, Fungicide and Rodenticide Act, as amended ( FIFRA ) 7 U.S.C. section 136(a)(1), by issuing a Complaint and Notice of Opportunity for Hearing ( Complaint ) on March 21, 2024 in accordance with the Consolidated Rules of Practice Governing the Administrative Assessment of Civil Penalties and the Revocation/Termination or Suspension of Permits at 40 C.F.R. Part 22.
