This Administrative Settlement Agreement and Order on Consent (Settlement) is
entered into voluntarily by the United States Environmental Protection Agency (EPA) and BNSF
Railway Company (BNSF), Puget Sound Energy, Inc. (PSE), and the State of Washington
(State) (Respondents). This Settlement provides for the performance of a Remedial Design (RD)
by PSE and BNSF (collectively Performing Respondents) and the payment of certain response
costs incurred by the United States at or in connection with the Quendall Terminals Superfund
Site comprising approximately 51 acres, including 29 acres in Lake Washington, located at 4503
Lake Washington Boulevard in Renton, King County, WA (?Site?)
