EPA is issuing a Consent Agreement and Final Order (CAFO) commencing and concluding an action against Buckeye Terminals, LLC (Buckeye) located in Flint, Michigan to resolve violations of the Michigan State Implementation Plan and the NESHAP for Gasoline Distribution Bulk Terminals, Bulk Plants, and Pipeline Facilities at 40 C.F.R. Part 63, Subpart BBBBBB. Specifically, Buckeye failed to properly control VOC emissions from a 2.8-million-gallon gasoline tank and failed to make timely repairs to the tank's VOC control system. EPA had issued a Notice and Finding of Violation (NOV/FOV) to Buckeye on September 6, 2023 alleging these violations. Buckeye has replaced the primary and secondary seals on the tank's internal floating roof, has made numerous other repairs, and has taken additional preventative maintenance steps to mitigate future emissions. The CAFO requires Buckeye to pay a $100,000 penalty to the federal government.
