EPA conducted an inspection of the Facility from May 17 to May 19, 2022, to determine Respondent'.s compliance with Section 112(r) of the CAA, 42 U.S.C. ? 7412(r), and 40 C.F.R. Part 68. On November 20, 2023, the EPA sent the Respondent a Notice of Potential Violation and Opportunity to Confer letter. On December 20, 2023, the EPA met with the Respondent as a result of the opportunity to confer and articulated the EPA's position concerning the Respondent's compliance with Section 112(r) of the CAA, 42 U.S.C. ? 7412(r) regarding the Inspection. EPA determined five violations for the CAA Risk Management Program.
